Class Action
This action was commenced in February, 2007. The parties have entered into an agreement to settle this matter. The settlement agreement is subject to court approval. A hearing took place on April 22, 2008 in Barrie, Ontario before Justice R. MacKinnon of the Ontario Superior Court of Justice. The settlement agreement was approved by Justice MacKinnon subject to the successful completion of the opt-out process. Once the Order approving the settlement agreement becomes a Final Order on May 22, 2008 members of the Class shall be mailed notice of the Order together with an Opt-Out Form.
